Gerald Chan
Gerald Chan's practice encompasses all areas of intellectual property law, including patent prosecution, patent litigation, opinion work, due diligence, and counseling. He has represented clients on matters involving a variety of technologies including telecommunications, medical devices, imaging devices, hearing aids, firewall technologies, sport equipment, mechanical systems, software, electronics, and business methods.
Gerald’s patent prosecution experience covers a wide variety of technical fields. He personally manages and prosecutes significant portfolios of patents for his clients, which include some of the largest companies in Silicon Valley and overseas, and provides counseling for his clients to develop successful IP strategies in highly competitive environments.
Gerald has had considerable experience on intellectual property disputes, including high-stakes patent and commercial lawsuits involving technology companies, both domestic and foreign. During the course of his legal career, he has been involved with substantial and complex cases in various federal courts and before the International Trade Commission. He has represented and counseled numerous companies, including some of the largest manufacturing companies in Taiwan.
Gerald has provided legal opinions for various companies, including non-infringement opinions and invalidity opinions. Gerald has also assisted companies in lawsuit’s pre-filing investigation, and in preparation for defense against threats of disputes.
Gerald is fluent in Chinese.
REPRESENTATIVE CASES
Certain Color Television Receivers and Color Display Monitors, and Components Thereof, Inv. No. 337-TA-534 (ITC). Represented various BenQ companies as respondents in patent infringement investigation initiated by Thomson Licensing, Inc. relating to LCD technology, color television receivers, and color television monitors.
Foxconn Electronics, Inc. and Hon Hai Precision Industry Co., Ltd. v. Lotes Co., Ltd., Civil Action No. 2-05CV-265 (Easter District of Texas). Represented Foxconn and Hon Hai in patent infringement suit against Hon Hai relating to computer components.
Townshend Intellectual Property, LLC. v. Boradcom Corp., Civil Action No. C06-05118 (Northern District of California). Represented Townshend in patent infringement suit against Broadcom relating to modem technology.
GIV, Inc. v. Lenovo, Case No. 3:07cv1132 (Eastern District of Virginia). Represented Lenovo in patent infringement suit by GIV relating to cursor control technology.
Aerus, LLC. v. ProTeam, Inc., Civil Action No. 05CV1065 (Southern District of California). Represented Aerus in patent infringement suit against ProTeam relating to vacuum and suctioning devices.
Maquet v. Terumo. Represented Maquet in patent infringement suit against Terumo relating to vein harvesting devices and methods.
Morris v. HP. Represented HP in patent infringement suit against Morris relating to computer networking technologies.
